Terms of Use

These Terms of Use (the “Terms”) form a binding agreement between you and Eagle Crest Treasure LLC (“Eagle Crest Treasure LLC,” “we,” “us,” or “our”), the operator of ECTreasure Events (the “Service”). They govern your access to and use of the Service, including our website at ectreasure.com, the event-planning application, and every public event page, invitation, and email delivered through it.

Please read these Terms carefully. By creating an account, purchasing a plan, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Refund Policy, and Cookie Policy, each incorporated here by reference. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and “you” refers to that organization.

1. Definitions

“Account” means your registered ECTreasure Events account. “Owner” means the account holder who creates and manages an event. “Guest” means a person invited to an event or who visits a public event page. “Your Content” means the event details, guest lists, contact details, text, images, audio, and other material you submit to the Service. “Guest Data” means personal information about Guests that you collect or upload, including names, email addresses, phone numbers, RSVP responses, meal choices, messages, and photographs.

2. The Service

ECTreasure Events is an online platform for planning and hosting events. It lets you manage guest lists and RSVPs, budgets, schedules, seating and table plans, meal choices, photo and video galleries, background music, digital invitations and e-cards, QR codes and event programs, background visitor analytics, and a publishable public event page, among other features. We may add, change, or remove features, and may offer some features only on certain plans. We may also make beta or preview features available; these are provided on an “as is” basis and may be changed or withdrawn at any time.

3. Eligibility & accounts

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, and able to form a legally binding contract, to create an Account. The Service is not directed to children, and we do not knowingly permit anyone under 18 to register.

You agree to provide accurate, current, and complete information when you register and to keep it up to date. You are responsible for safeguarding your password and for all activity that occurs under your Account. You must notify us promptly at sales@ectreasure.com if you suspect any unauthorized use of your Account. We are not liable for loss arising from your failure to keep your credentials secure.

4. Plans, billing & auto-renewal

The Service offers free and paid plans, and optional paid add-ons (such as additional events). Paid plans are sold as subscriptions billed in advance on a monthly or annual basis, and, unless stated otherwise at purchase, renew automatically at the end of each billing period at the then-current price until you cancel. You authorize us and our payment processors to charge your payment method for each renewal.

You may cancel auto-renewal at any time from your Account; cancellation takes effect at the end of the current paid period, and you retain paid features until then. Prices, plan features, and limits may change; for a change that affects a plan you are currently paying for, we will make reasonable efforts to notify you in advance, and the change will apply from your next renewal. Certain paid plans may require verification or approval before activation.

You are responsible for all applicable taxes, and for any bank, card, or currency-conversion fees. If a payment fails or is reversed, we may suspend or downgrade paid features until the amount due is settled. You agree not to initiate a chargeback or payment dispute without first contacting us in good faith to resolve the issue.

5. Refunds

Refunds are governed by our Refund Policy. As described there, a non-refundable administrative charge of 7% is retained on every refund to cover irrecoverable processing and servicing costs. Nothing in these Terms limits any non-waivable refund or cancellation right you may have under applicable consumer-protection law.

6. Payment processing & third-party services

Payments are processed by third-party payment providers (such as Stripe and Paystack). We do not collect or store full card numbers or bank credentials; that information is handled by the payment provider under its own terms and privacy policy, and your use of a paid plan is also subject to those terms. The Service may also rely on other third-party services (for example, map links, web fonts, and email delivery). We are not responsible for third-party services, and their availability is outside our control.

7. Acceptable use

You agree not to use the Service to: (a) break any law, regulation, or third-party right; (b) upload or publish content that is unlawful, hateful, harassing, threatening, defamatory, obscene, sexually exploitative (especially of minors), or that infringes intellectual-property or privacy rights; (c) impersonate any person or misrepresent your affiliation; (d) upload malware or attempt to probe, scan, disrupt, overload, reverse-engineer, or gain unauthorized access to the Service, its infrastructure, or other accounts; (e) send spam, unlawful, or unsolicited communications; (f) scrape or harvest data, or use the Service to build a competing product; or (g) collect or use any person’s personal data without a lawful basis and any consent the law requires. You are solely responsible for having the authority and permissions to add the Guests and contact details you upload and to send them the invitations and messages you initiate.

8. Your Content & license

As between you and us, you retain all ownership of Your Content. You grant Eagle Crest Treasure LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for formatting and display), transmit, and display Your Content solely to operate, provide, secure, and improve the Service and to perform the actions you request — for example, publishing your public event page, generating invitations and QR codes, and sending the emails you initiate. This license ends when Your Content is deleted, except for residual copies retained in routine backups for a limited period and any content others have lawfully re-shared. You are responsible for Your Content and represent that you hold all rights necessary to submit it and grant this license.

9. Guest data & data protection

When you upload or collect Guest Data, you are the data controller of that information and Eagle Crest Treasure LLC acts as your data processor, processing Guest Data on your documented instructions to provide the Service. You are responsible for establishing a lawful basis for your collection and use of Guest Data, for providing any notices and obtaining any consents the law requires (including before uploading a person’s details or sending them messages), and for honoring Guests’ rights.

Where the EU General Data Protection Regulation (GDPR), the UK GDPR, the California Consumer Privacy Act as amended by the CPRA (CCPA/CPRA), or similar laws apply to Guest Data, we will: process it only on your instructions and as needed to provide the Service or comply with law; apply appropriate technical and organizational security measures; make available information reasonably necessary to demonstrate compliance and assist with data-subject requests and, where required, data-protection impact assessments; not “sell” or “share” personal information as those terms are defined by the CCPA/CPRA; and, on termination, delete or return Guest Data as described in our Privacy Policy, subject to legal retention requirements. Guests may exercise applicable rights (such as access, correction, deletion, restriction, portability, and objection) as set out in the Privacy Policy; requests that concern a specific event are directed first to the relevant Owner. Our processing of your own Account information as a controller, and further detail on international transfers and security, are described in the Privacy Policy.

10. Public event pages

You choose whether your event page is published and which sections and items appear on it. Anything you make public may be viewed, indexed, downloaded, or shared by others, and we cannot control what third parties do with it once it is public. Do not publish sensitive personal information about any Guest without that Guest’s consent. You are responsible for moderating guestbook messages, stories, and other Guest submissions on your event page.

11. Emails & communications

The Service sends the communications you initiate (such as invitations, RSVP confirmations, reminders, and thank-you messages) and essential Account emails (such as verification and password-reset codes and billing notices). You are the sender of the event communications you initiate, you are responsible for their content and for having permission to contact each recipient, and you agree to comply with all applicable anti-spam and electronic-marketing laws (including the U.S. CAN-SPAM Act and any consent, identification, and opt-out requirements that apply to your recipients). You consent to receive essential service and transactional emails from us for as long as you hold an Account.

12. Intellectual property

The Service — including its software, design, text, graphics, logos, and the ECTreasure Events and Eagle Crest Treasure LLC names and marks — is owned by Eagle Crest Treasure LLC or its licensors and is protected by intellectual-property laws. Except for the rights expressly granted to you to use the Service under these Terms, no license or right is granted, and you may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.

13. Administrator access

Authorized ECTreasure Events administrators may access an Account to provide support, ensure security, enforce these Terms, or maintain the Service. Such access is limited, controlled, and logged, and is handled in accordance with our Privacy Policy.

14. Availability & changes to the Service

We work to keep the Service available but do not warrant that it will be uninterrupted, timely, secure, or error-free. We may modify, suspend, or discontinue any part of the Service, temporarily or permanently, with or without notice. We are not liable to you for any modification, suspension, or discontinuation, except as required by law.

15. Suspension & termination

You may stop using the Service and request deletion of your Account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, fail to pay amounts due, or create legal risk or harm for the Service, us, or others. On termination, your right to use the Service ends and your events and associated data may be deleted, subject to any legal retention obligation and to the deletion process in our Privacy Policy. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.

16. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet your requirements, that Your Content or Guest Data will always be accurate, preserved, secure, or available, or that defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

17. Limitation of liability

To the maximum extent permitted by law, Eagle Crest Treasure LLC and its owners, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of (or inability to use) the Service, however caused and on any theory of liability. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) fifty U.S. dollars (US$50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing here limits liability that cannot be limited by law.

18. Indemnification

You agree to indemnify, defend, and hold harmless Eagle Crest Treasure LLC and its owners, officers, employees, and suppliers from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to Your Content, your Guest Data practices, your use of the Service, or your violation of these Terms, of any law, or of any third-party right.

19. Governing law & dispute resolution

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles, and, where applicable, by U.S. federal law. Before filing any claim, you agree to first contact us at sales@ectreasure.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in the jurisdiction stated above, and you and Eagle Crest Treasure LLC consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction. This governing-law choice does not deprive you of the protection of mandatory consumer-protection provisions of the law of the country in which you reside.

20. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Effective date” above and, for material changes, take reasonable steps to notify you (for example, by email or an in-app notice). Changes take effect when posted unless stated otherwise, and your continued use of the Service after they take effect means you accept the updated Terms. If you do not agree to a change, stop using the Service and, if applicable, cancel your subscription.

21. General

These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding the Service and supersede any prior agreements on that subject. If any provision is held unenforceable, the remaining provisions stay in effect and the unenforceable provision will be limited or replaced to the minimum extent necessary. Our failure to enforce any right is not a waiver of it. You may not assign or transfer these Terms without our consent; we may assign them to an affiliate or successor, including in connection with a merger, acquisition, or sale of assets. These Terms create no third-party beneficiaries. We will not be liable for any failure or delay caused by events beyond our reasonable control (including acts of God, outages, network or hosting failures, and government action). Notices to you may be given by email or through the Service; notices to us should be sent to sales@ectreasure.com.
